PREAMBLE – DESIGNATION OF THE SELLER

These General Conditions of Sale and Use (hereinafter "GTCSU") govern the contractual relations for any purchase of "Work" made on the site https://www.adelaide-artiste.com, between any person (natural or legal) having placed an order via said site (hereinafter “the Customer”), and:

Ei Adelaide Artist (hereinafter "the Artist")

Artist-author registered with the Maison des Artistes de Paris and whose sole proprietorship is registered under the number of Siret 88362988300017  and whose head office is located at 9 rue de Condé, Office 3, 33000 Bordeaux.

The Customer acknowledges that by ticking the words "I have read and I accept the general conditions of sale", he accepts these general conditions of sale.

Consequently, the fact of placing an order implies the Customer's full and unreserved acceptance of these general conditions of sale.

These general conditions of sale cancel and replace all previous agreements, written or verbal, existing with the Customer, concerning the sale of the Works and prevail, unless expressly agreed otherwise, over any conditions set by the Customer.

The Customer, prior to his order, declares that the acquisition of these Works is not directly related to his professional activity, their acquisition being reserved for his personal use.

As a consumer, the Customer has specific rights, which would be called into question in the event that the Works acquired within the framework of the website would, in reality, have a relationship with his professional activity.

The Artist reserves the right to modify its T&Cs at any time.

In the event of modification of the GCS, the applicable GCS are those in force on the date of the order, a copy dated to date of which can be given to the Customer, at his request.
In any event, a Customer may read the current T&Cs by clicking on the "T&Cs" link.

 

 

 

Article 1. BOJET

The present general conditions, aim to define between the parties hereinafter referred to, the legal terms of use and purchase of products through the website www.adelaide-artiste.com

By parties, it is understood on the one hand L'EI Adélaïde Artiste, whose registered office is located at 9 rue de Condé, Office 3, 33 000 Bordeaux.

Hereinafter referred to as "the seller"

And

Any natural person having the quality of consumer and making a purchase via the website (www.adelaide-artiste.com).

Hereinafter referred to as "the buyer" or the "consumer".

By using this website or prior to any order on it, you acknowledge having read these general conditions and expressly declare to accept them without reservation. 

These Terms may be subject to change at any time without notice. It is your responsibility to consult them regularly, because the applicable conditions will be those in force at the time of use of the website or during the validation of the order.

Article 2. USESITE #

By using this website and placing orders on it, you agree to:

1. Use this website only to place legally valid orders.

2. Do not place any false or fraudulent orders. If it can reasonably be considered that an order of this nature has been placed, we will be authorized to cancel it and inform the competent authorities.

 

3. Provide us with a correct and accurate e-mail address, postal address and/or other contact details. Likewise, you authorize us to use this data so that we can contact you if necessary.

By placing an order on this website, you affirm that you are over the age of 18 and that you have the legal capacity to enter into contracts.

Item 3. INTRAINING RELATED TO WORKS OF ART ON SALEYOU:

All the works offered for sale on the site www.adelaide-artiste.com are original paintings by Adelaide Artist.

 

Thus, each work:​

  • is initialed by the artist on the front, 

  • is named, dated and signed on the back, in indelible marker;

  • comes with an invoice and a certificate of authenticity registered on the Blockchain Ipocamp.

These two documents (invoice and certificate of authenticity combined) can be used as proof in the event of transfer/sale of the work after purchase or request for tax deduction (for companies). To avoid any risk of fraud, no duplicate of this certificate will be issued, except in cases of force majeure.

These measures have been taken to thwart as much as possible any risk of reproduction or falsification of the artist's works, given their permanent presence on the Internet.

Moreover, these works being all unique pieces:

  • Their sale is limited to one piece (*) per item (no stock or exchange possible). It is specified that despite daily management of the website www.adelaide-artiste.com, some paintings announced as being available may not actually be, due to technical and practical considerations (computer problem, sale of works on several different websites, sale possible also in the exhibition gallery,...). To obtain additional details, the Client has the option of contacting the artist. In the event that the work turns out to be unavailable once the act of purchase has been made, the artist will reimburse the customer in full, as soon as possible;

  • They are not reproducible. The artist does not offer any reproduction of his works (*) and by virtue of the related copyrights, it is forbidden to make copies, even after purchase. Any abuse will be punished by law;

It is recalled that the copyright of the works offered on the site www.adelaide-artiste.com remain the sole property of the artist, even after their sale and this, in a permanent and unchanging manner. The client cannot therefore use, distribute or reproduce them in any way whatsoever, without the prior written consent of the artist.

Finally, it is recommended that potential customers be wary of any counterfeiting of the artist's works. For the record, no work is ever reproduced by it identically, nor any copy is made in any form whatsoever. In addition, all of the artist's works are signed, and carry specific identification numbers. It is therefore up to potential customers to refuse any offer in this regard, from a company other than the EI Adélaïde Artiste structure and to immediately inform the artist, who cannot be held responsible in the event of fraud and will immediately seize the competent authorities to assert its copyrights.

The artist draws the attention of potential customers to the fact that the photographs of the works listed on his website are not contractual: they may sometimes turn out to be slightly different from reality, due to numerous technical parameters such as the quality of the graphics card of the Customer's computer, the quality and settings of its screen and the lighting of the artist during the shots. However, the changes can therefore only be minimal. In addition, the works are generally more beautiful in reality than in the photo, this process tending to "flatten" the materials.

All purchases of products are therefore subject to their availability in stock. Otherwise, the seller will inform the consumer.

The products presented are photographed and are presented with the greatest possible accuracy. However, the colors may vary slightly from the screen and its brightness. The browser used may also not respect reality. However, if errors or omissions may have occurred concerning this presentation, the responsibility of the seller could not be engaged.

Article 4. AVAILABILITY OF SERVICES

The items for sale on this website are only available for delivery in metropolitan France. 

Article 5. VALIDITY OF OFFERS AND PRICES

The validity of the offer depends on the products presented on the site (www.adelaide-artiste.com) as well as their availability in stock. In case of unavailability of the product, the seller undertakes as far as possible to notify you before the validation of your payment. Otherwise, if payment has already been made, we will refund all amounts paid, including any delivery costs as soon as possible, using the same method of payment as the one you used during the transaction. In any case, this reimbursement will not entail any costs to be borne by you.

The prices are all indicated in Euros including VAT. The products will be invoiced on the basis of the prices in force at the time of the registration of the orders. In addition, the seller reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the online store on the day of the order will be the only one applicable to the Consumer.

 

Article 6. FORMATION OF THE CONTRACT  

To place an order, you must follow the online purchase procedure and click on "Purchase".  It is recalled that by clicking on "Purchase", you acknowledge having read these general conditions of sale and expressly declare to accept them without reservation. The contract is formed upon the purchaser's order, formalized by this click. 

You will then receive an email acknowledging receipt of your order (hereinafter the “Order Confirmation”). You will also be informed by email of the effective dispatch of your order.

 

Article 7. PURCHASE PROCEDURE

The buyer may place his order on the site www.adelaide-artiste.com as follows:

  • Product choice

  • Validation of basket contents

  • Information of your e-mail. Your order confirmation and shipment confirmation will be sent to this address. 

  • Information of your delivery address and your telephone number

  • Choice of payment method payment by credit card or Paypal and billing address

  • Verification of the data communicated and of the order, acceptance of the GCS and payment

  • A confirmation email will be sent to you to confirm your payment and the related order.

The consumer will be able to modify his basket and his coordinates before the validation of the payment. The total cost of the cart contents is displayed on the order summary page. Only payments in Euros are accepted. 

Article 8. REFUSAL TO PROCESS AN ORDER 

Although we will always make every effort to fulfill all orders, exceptional circumstances may arise which require us to refuse to process an order after sending you the Order Confirmation, such as a manufacturing problem or to stock, a payment incident or a regulatory problem. We reserve this right at all times. In this case, if payment has already been made, we will refund all amounts paid, including delivery costs as soon as possible, using the same method of payment as the one you used during the transaction. In any case, this refund will not incur any costs for you. 

We reserve the right to withdraw, at any time, any product from this website and to replace or modify any content or information appearing on it. 

We shall not be liable to you or to any third party for our decision to remove a product from this website, to replace or modify any content or information on this website or for our refusal to process an order, in the cases referred to above, after having sent the Order Confirmation.

Article 9. PAYMENT

The price is payable when ordering and in one go. Any attempt at fraud, for any amount whatsoever and whatever its origin, will be subject to criminal prosecution.

 

Method of payment 

The payment methods offered are by credit card or via a Paypal account. Regarding payment by credit card, the buyer validates his delivery and billing address as well as the product and the total price. He provides the number of his credit card associated with the expiry date and the CVX code. The order can then be finalized.

The choice of credit card is protected by the Stripe solution, which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software, and that no third party can read it during transport. on the network.

Default of payment:

The seller reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully paid for an order.

 

Verification of payments

By clicking on "Purchase", you confirm that the credit card belongs to you.

The seller checks all the orders that have been validated on his site. These controls aim to protect the seller from abusive practices operated by fraudsters. Our services may ask you for all the documents necessary to release your order: proof of address or debit in your name, or proof of address in the name of the person indicated for the delivery address, etc. These requests will be made by email. 

Credit cards are subject to validity checks and authorization by the organization issuing these cards. If we do not receive the required payment authorization, we will not be liable for any delay or failure to deliver the products and we will not be able to enter into a contract with you. 

 Payment security

In order to ensure payment security, the www.adelaide-artiste.com site uses Stripe's secure payment service. This Service incorporates, as previously stated, the SSL security standard.

Article 11. DELIVERY

Delivery terms:

The products sold on the site are deliverable in metropolitan France only at home.

Delivery times: 2 to 4 weeks, except for personalized orders whose delivery times will be defined via the customer quote.

Shipping pricing policy

Upon withdrawal, you are the owner and responsible for the product. Any damage to the product occurring after the day of withdrawal will be considered as resulting from your own doing and cannot be opposed to the seller for a refund or exchange request.

Warning: 

All products sent by the seller are carefully checked and contain no damage so that if your order has arrived damaged and you still collect the product, it will be considered that you accept the package in its condition on the day of collection. Thus, any damage to the product occurring after the withdrawal will be unenforceable against the seller and cannot be the basis for a request for reimbursement or exchange.

Insurance: 

The works produced by Adélaïde Artiste are insured by the artist as long as they are in his possession.

Once the act of purchase has been made, it is up to the customer and to him alone, to insure the work(s) purchased according to its (their) value, with the company of his choice.

This implies that the artist cannot  be held responsible for any damage to the work or any theft, once the act of purchase has been made.

 

Article 12. DELAY, LOSS, DAMAGE

Delay

No delay in delivery can engage the responsibility of the seller from the deposit of the package at the post office. In this case, you should contact the service of the carrier in question.  

As an exception, the seller allows the consumer to denounce the purchase in the event of a delay of more than 30 days.

Loss:

In the event of loss of the package, we undertake at your convenience to reimburse you in full as soon as possible. 

Article 13. RETURN AND RIGHT OF WITHDRAWAL 

The Consumer benefits from 14 clear days from the day of receipt of the product to exercise his right of withdrawal. Within this time limit, the exercise of this right takes place by informing the seller by email at the following address: contact.adelaide.artiste@gmail.com; of your desire to withdraw from the contract by imperatively specifying the reasons for the return as well as the return of the goods in the same condition as on the day of delivery. These two actions must cumulatively be done within 14 clear days from the day of receipt of the product. The exercise of this right makes it possible to obtain reimbursement. Return costs remain the responsibility of the customer.

Returned products (product and packaging) must be in their original condition. Upon receipt of the package, the seller will judge compliance with the time limit and the perfect condition of the returned goods. No returns will be accepted if the products have been visibly used or damaged by the purchaser. If the return is refused, no refund or exchange may be required and the return of the order will be at the expense of the Consumer. The refund will be made within 14 days of receipt of the goods by the seller, of which you will be informed by email. 

Custom order:

The right of withdrawal is not applicable to the order of personalized works, in accordance with the provisions of article L221-28, 3° of the Consumer Code.

Article 14. RESPONSIBILITY AND APPLICABLE LAW

The seller cannot be held liable for damages of any kind, whether material, immaterial or bodily, which may result from improper use of the products marketed. The seller cannot be held liable for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products. 

This contract is subject to French law. Only the French courts are competent whatever the place of delivery and the method of payment accepted.

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to present their complaints. In the event of a dispute, the consumer will first contact the company to obtain an amicable solution.
